Welcome to 702Greens. By accessing or using our website (the “Site”) at 702greens.com, you agree to comply with and be bound by the following terms and conditions (the “Terms of Use”). Please review the following terms carefully. If you do not agree with these terms, you should not use this Site.

1. Acceptance of Agreement
You agree to the terms and conditions outlined in this Terms of Use Agreement (the “Agreement”) with respect to our Site. This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties, and understandings with respect to the Site, the content, products, or services provided by or through the Site, and the subject matter of this Agreement. We may amend this Agreement at any time, without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.

You may not use the Site for any other purpose, including any commercial purpose, without our express prior written consent.

4. Product and Service Descriptions
We strive to be as accurate as possible in our product descriptions. However, we do not warrant that product descriptions or other content on the Site is accurate, complete, reliable, current, or error-free. If a product offered by 702Greens is not as described, your sole remedy is to return it in unused condition.

5. Orders and Payments
When you place an order through the Site, you are agreeing to purchase the products and services in accordance with these Terms of Use. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. All prices are subject to change without notice.

6. Subscription Services
702Greens offers subscription services that include recurring delivery of products. By subscribing, you agree to pay the subscription fees as described on the Site. You may skip, pause, or cancel your subscription at any time by emailing us at hello@702greens.com; however, please provide at least one week’s notice to allow us to adjust your order accordingly. Any payments made prior to these changes taking effect are non-refundable.

Please note that we are a grow-to-order company, meaning all produce orders are grown specifically for you.

7. Shipping and Delivery
702Greens offers delivery services for our products. To ensure the successful delivery of your order, please provide us with all necessary information, including accurate address details, gate codes, and any special instructions. If we are unable to deliver your order due to missing or incorrect information, or if no one is available to receive the delivery, it is your responsibility to ensure that a cooler is left out to maintain maximum freshness. We are not responsible for the quality of the product if these conditions are not met.

8. Refunds and Returns
Due to the perishable nature of our products, all sales are final. We cannot accept returns or exchanges. However, if there is an issue with your order, please contact us within 24 hours of delivery at hello@702greens.com, and we will do our best to address the concern.

9. Skipping Deliveries
If you wish to skip a delivery, you must provide adequate notice according to your delivery cycle, typically 1-2 weeks in advance. This allows us to adjust our growing and delivery schedule accordingly. Failure to provide sufficient notice may result in the delivery being processed as usual.

10. Modifications to Service and Prices
Prices for our products are subject to change without notice. We reserve the right to modify or discontinue the Service (or any part or content thereof) without notice at any time.

11. Accuracy of Billing and Account Information
You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

12. Intellectual Property Rights
All content, organization, graphics, design, compilation, magnetic translation, digital conversion, and other matters related to the Site are protected under applicable copyrights, trademarks, and other proprietary rights (including but not limited to intellectual property) and are the property of 702Greens. The copying, redistribution, use, or publication by you of any such matters or any part of the Site, except as allowed by Section 2, is strictly prohibited. You do not acquire ownership rights to any content, document, or other materials viewed through the Site.

13. Limitation of Liability
702Greens shall not be liable for any special, incidental, indirect, or consequential damages of any kind, or any damages whatsoever resulting from loss of use, data, or profits, whether or not we have been advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the use or performance of the Site or the failure to provide products or services that you order from us.

14. Indemnification
You agree to indemnify, defend, and hold harmless 702Greens, its officers, directors, employees, agents, licensors, suppliers, and any third-party information providers to the Site from and against all losses, expenses, damages, and costs, including reasonable attorneys' fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Site.

15. Termination
We may suspend or terminate your access to the Site at our sole discretion, without notice and for any reason, including if we believe you have violated these Terms of Use.

16. Governing Law
This Agreement shall be treated as though it were executed and performed in the State of Nevada, and shall be governed by and construed in accordance with the laws of the State of Nevada without regard to its conflict of law principles. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party.
